TERMS AND CODITIONS
In consideration of participating in the Gervais Street Bridge Dinner on October 10, 2021 (the "GSBD" or “event”), I do hereby waive, release, forever discharge, and hold harmless Carolina Together and its director, employees, volunteers, board members, independent contractors, agents, successors, and assigns (collectively, the “Released Parties”) from and against any and all liability in connection with my participation in the event, including but not limited to claims, demands, actions or causes of action, costs or expenses arising out of damages, personal injury, or death, which may result from my participation in the GSBD. In executing this Waiver of Liability and Release, it is my intent to fully waive, release, and discharge the Released Parties, and to hold them harmless, from any and all liability in connection with my participation in the GSBD to the fullest extent permitted by law.
By purchasing an admission ticket(s) and/or sponsorship(s) and entering the event, I am acknowledging and confirming on my behalf, and on behalf of any individual who uses the admission ticket(s) I purchase to enter the GSBD, A that I submit to my temperature being taken prior to entry. B. all guests are recommended to wear face coverings when not actively eating or drinking. The use of face coverings should not be seen as a substitute for physical distancing. C. Directional signage has been installed to assist Guests to responsibly move throughout the event.
By purchasing an admission ticket(s) and/or sponsorship(s) and entering the event, you are acknowledging and confirming on your behalf, and on behalf of any individual who uses the admission ticket(s) you purchased to enter the GSBD, both now and in the future, that you understand and voluntarily expressly assume the risk that during your visit you may be exposed to COVID-19, the Coronavirus that causes COVID-19, or other communicable and/or infectious diseases. You expressly understand that these risks include contracting COVID-19 or other communicable and/or infectious diseases and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other communicable and/or infectious diseases. You further acknowledge and understand that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting communicable and/or infectious diseases, including, but not limited to, COVID-19 and the Coronavirus that causes COVID-19, that Carolina Together cannot guarantee that you will not be exposed during your visit to the event, and that as such, potential exposure to or contraction of COVID-19 or any other communicable and/or infectious diseases are risks inherent in your decision to visit the GSBD and cannot be eliminated. You further acknowledge and understand that if infected with COVID-19, the Coronavirus that causes COVID-19, or any other communicable and/or infectious disease, you may infect others you subsequently come in to contact with, even if you are not experiencing or displaying any symptoms of illness yourself, and that the risk of spreading COVID-19 to others remains even after the you depart the Properties. The same is true for many other communicable and/or infectious diseases you may be exposed to during your visit.
I also understand, and it is my full intent, that this Waiver of Liability and Release binds (in addition to myself) my heirs, personal representatives, administrators, assigns, and any and all other individuals or entities who may have a claim or who may assert a claim by virtue of any injury or damage that I may incur during my participation in the GSBD.
When you enter the Gervais Street Bridge Dinner (“GSBD”) event, you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by GSBD and its affiliates / representatives. Images, photos and/or videos may be used to promote similar GSBD events in the future, highlight the event and exhibit the capabilities GSBD.
You release GSBD, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by GSBD or the person or entity designated to do so by GSBD. When you enter GSBD, you have consented, waiver of liability.
I agree that in the event that any portion of this Waiver of Liability and Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver of Liability and Release, which shall continue to be enforceable.
To the extent that any reviewing court may conclude that this Waiver of Liability and Release is too broad to be legally enforceable, I hereby declare my intention that the court enforce it to the fullest extent the law would allow, or to otherwise modify this Waiver of Liability and Release to fully account for my unequivocal intent to release the Released Parties from liability as consideration for allowing me to voluntarily participate in the GSBD.
By purchasing an admission ticket(s) and/or sponsorship(s) and entering the event, I acknowledge that I have read and understand this entire Waiver of Liability and Release and agree to be bound by it.
